This matter comes before the Iowa Public Information Board (IPIB) this 20th day of April, 2023, to review compliance with the terms of an Informal Resolution.
The IPIB accepted the complaint against the City of Hamburg on July 21, 2022. Pursuant to Iowa Code ยง 23.9, the parties negotiated and reached a proposed Informal Resolution. The Informal Resolution was approved by the IPIB on November 17, 2022.
The terms of the Informal Resolution were believed to have been completed, but there is disagreement between the parties as to whether the terms have been successfully completed. The dispute arises over the inability of the City to produce additional documents Mr. Johnson received from another agency. The city provided an affidavit that it did conduct a search for emails by the city clerk pursuant to the terms of the Informal Resolution. The Final Report recommends the IPIB dismiss the complaint as resolved. The IPIB agreed to dismiss this complaint upon completion of the terms.
Pursuant to the terms of the Informal Resolution, this complaint is dismissed.

Final Report
Comes now Erika Eckley, Executive Director for the Iowa Public Information Board (IPIB) and
requests that the IPIB dismiss this complaint as successfully completed and as grounds therefore
state the following:
The IPIB accepted the complaint against the City of Hamburg on July 21, 2022. Pursuant to Iowa
Code ยง 23.9, the parties negotiated and reached a proposed Informal Resolution. The Informal
Resolution was approved by the IPIB on November 17, 2022.
As noted in the attached report by Brett Toresdahl, the terms of the Informal Resolution were
believed to have been completed, but there is disagreement between the parties as to whether the
terms have been successfully completed. The dispute arises over the inability of the City to
produce additional documents Mr. Johnson received from another agency. The city provided an
affidavit that it did conduct a search for emails by the city clerk pursuant to the
terms of the Informal Resolution.
The Final Report recommends the IPIB dismiss the complaint as the terms of the
informal resolution have been completed.
