THIS MATTER comes before the Iowa Public Information Board (IPIB) this 15th day of October, 2020, to consider acceptance of a joint stipulation and proposed form of decree.
On November 26, 2019, Jason Clayworth filed formal complaint 19FC:0138 alleging that the Des Moines Water Works (DMWW) violated Iowa Code chapter 22.
The IPIB voted to accept formal complaint 19FC:0138 on July 16, 2020. Pursuant to Iowa Code section 23.9, the parties negotiated and agreed to a joint stipulation and proposed form of decree.
IT IS THEREFORE ORDERED:
The IPIB has reviewed the joint stipulation and proposed form of decree and approves it pursuant to Iowa Administrative Rule 497-2.4(3).
Upon showing proof of compliance, the IPIB shall dismiss this complaint as successfully resolved.

COMES NOW, Zachary S. Goodrich, Legal Counsel for the Iowa Public Information Board (IPIB), and respectfully submits this Informal Resolution Report.
On November 26, 2019, Jason Clayworth filed formal complaint 19FC:0138 alleging that the Des Moines Water Works (DMWW) violated Iowa Code chapter 22. Mr. Clayworth submitted a records request on November 14, 2019 to DMWW requesting copies of any settlement agreements entered into between DMWW, Scott Allen Richardson, and On Point Security Group LLC (On Point).
The IPIB voted to accept formal complaint 19FC:0138 on July 16, 2020, after finding that the complaint was within the IPIB’s jurisdiction, appeared legally sufficient, and could have merit. The parties negotiated and agreed to terms which will resolve this matter, pending IPIB action (see attached).
It is recommended that the IPIB agree to the proposed terms of the informal resolution and direct the IPIB Chair to issue an order in compliance with the informal resolution.
