Approved Minutes
The Board met at 1:02 p.m. in the 3rd floor Conference Room with the following members present: Robert Andeweg, Urbandale; Jo Martin, Spirit Lake (by phone); Andrew McKean, Anamosa; Gary Mohr, Bettendorf; Bill Monroe, Johnston (by phone); Kathleen Richardson, Des Moines; Suzan Stewart, Sioux City; and Peg Weitl, Carroll (by phone). Also present were IPIB Executive Director Charlie Smithson, Deputy Director Margaret Johnson, and Administrative Assistant Cindy Meyerdirk. Unable to attend: Anthony Gaughan, West Des Moines.
Votes Taken
1) On a motion by McKean, seconded by Andeweg, the agenda was unanimously adopted.
2) On a motion by Mohr, seconded by Andeweg, the minutes of the August 20, 2015 meeting were adopted.
3) The closed session minutes of the August 20, 2015 meeting were removed from the agenda.
Public Forum
Members of the public requested to speak later in the proceedings as each noted case was called:
Marty Ryan from Fawkes-Lee & Ryan spoke on 22.7(65) (local government’s use of draft documents),
referencing cases Miller, Joel (15FC:0070) and Schoenebaum, Carrie (15FC:0047). Director Smithson
asked Mr. Ryan to submit a draft of his legislative proposal for board review and consideration.
Items Discussed
1) Chairperson Suzan Stewart commended the Iowa Utilities Board for its increased transparency in open government.
2) Stewart noted the presentations:

3) Staff updated the board:
a. Johnson discussed the website audience overview report.
b. Meyerdirk stated regular expenses have been processed. With permission from the board, financial
reports will be provided quarterly.
4) A list of the new and pending cases was provided.
5) The board was briefed on pending cases and took action as indicated:
◦ Alison, Dale (15FC:0030-Chapter 22-Iowa Department of Public Safety) acceptance.
◦ Klein, Adam (15FC:0034-Chapter 22-Des Moines County Attorney/DCI / Burlington Police Dept.)
acceptance. Several members of the public spoke on both cases.
Motion by Monroe, seconded by Mohr, to accept both cases (Alison 15FC:0030) and
Klein (15FC:0034) with Stewart, Richardson, Monroe, Mohr, Martin in favor, McKean, Andeweg and
Weitl opposed. Gaughan not in attendance.
◦ Kass, Steve (15FC:0008-Chapter 21-Shueyville City Council) dismissal. Motion by McKean,
seconded by Richardson, unanimously adopted.
◦ Gerot, George D. (15FC:0068-Chapter 22-Highland Community School District) additional
information has been received. Motion to table until the October meeting by Andeweg, seconded by
Mohr, unanimously adopted.
◦ Kilgore, Kevin (15FC:0064-Chapter 21- Iowa Public Employment Relations) dismissal. Motion by
McKean, seconded by Andeweg, unanimously adopted.
◦ Knowles, Richard (15FC:0038-Chapter 22-Crawford County Memorial Hospital) acceptance.

b. Kristy Latta, attorney for Waukee School District commented. Motion by Mohr, seconded by
Monroe, to redirect the matter back to the staff for further investigation, unanimously adopted.
◦ Schmit, Patti (15FC:0072 – Chapter 21 – City of Jesup) dismissal. Motion by Mohr, seconded by
Andeweg, unanimously adopted.
◦ Swan, Mary (15FC:0041-Chapter 21-Cedar County Board of Supervisors) report. Motion by McKean,
seconded by Martin, for the IPIB to approve the remediation plan and direct the chairman of IPIB to
sign the remediation plan on behalf of the IPIB, unanimously adopted.

9) Smithson asked the board’s permission to bring an opinion and draft of administrative rule for the board’s consideration at the October 2015 meeting that states a document presented at an open session of a public meeting becomes a public record. Motion by Mohr, seconded by Martin, to ask the executive director to develop a document dealing with documents at public meetings, unanimously adopted.
The next meeting date, to be held in the Wallace Building, 3rd Floor E/W Conference Room.
