COMES NOW Margaret E. Johnson, Executive Director for the Iowa Public Information Board (IPIB), and submits this Report recommending acceptance of the Informal Resolution and dismissal of the formal complaint as successfully completed.
Jacob Hackman filed formal complaint 18FC:0064 on August 8, 2018, alleging that the Chickasaw County Ambulance Council (Council) violated Chapter 21 of the Iowa Code (open meetings) by meeting in closed session without proper notice.
The Council held a meeting on July 26, 2018. The posted agenda did not list the possibility of holding a closed session during the meeting. The unapproved minutes indicate that a closed session was held, listing Iowa Code section “22.5(1c)” as the reason.
The 911 Director, A.J. Seeley, responded to the complaint. He was unaware that the agenda was insufficient. He was also unaware that the wrong code reference was used. He was informed that the complaint would be accepted.
The IPIB accepted the complaint on September 20, 2018. Pursuant to Iowa Code section 23.9, the parties negotiated and reached an informal resolution (attached).
The terms of this informal resolution require completion within 60 days of acceptance by all parties. Upon showing proof of compliance, the IPIB shall dismiss this complaint as successfully resolved.
The terms were completed on December 4, 2018, and proof of completion was provided to the IPIB. According to the informal resolution, the complaint should now be dismissed.
Therefore, it is recommended that the IPIB approve the informal resolution, direct the IPIB Chair to sign the informal resolution on behalf of the IPIB, and then dismiss this complaint as successfully completed.

THIS MATTER comes before the Iowa Public Information Board (IPIB) for acceptance of the informal resolution and dismissal of the complaint.
The IPIB finds that the terms of the Informal Resolution are appropriate.
The IPIB further finds that the terms of the Informal Resolution have been met and proof of compliance filed with the IPIB.
IT IS THEREFORE ORDERED that the informal resolution is approved and that the IPIB chair shall sign the informal resolution. The formal complaint is dismissed as successfully completed.
