  1.  Call to Order/Introductions

The Rules committee met at 11:30 a.m. on February 20, 2020, in the conference room of the Iowa Public Information Board (IPIB).  Present were committee members Julie Pottorff and Suzan Stewart, as well as staff, Margaret Johnson and Amanda T. Adams.  Also present were Randy Evans from the Freedom of Information Council, Susan Patterson-Plank from the Iowa Newspaper Association, Aleksey Gurtovoy, a member of the public, and also Martha Hampel, a member of the public.

Committee Member Julie Pottorff arrived at 11:35 a.m.

  1.  Approve Agenda

There was a motion to approve the agenda by Suzan Stewart, second by Julie Pottorff.  The agenda was approved unanimously.

  1.  Public Comment

There was no public comment.

  1.  Discussion of general rule-making authority

This will be discussed at a future meeting.

  1.  Discussion of proposing a rule to define “readily accessible” format and whether that includes metadata in Iowa Code section 22.3A(2)(d).

Members, staff, Randy Evans, Susan Patterson-Plank, Aleksey Gurtovoy, and Martha Hampel, discussed a proposed rule to define “readily accessible” format and whether that includes metadata in Iowa Code section 22.3A(2)(d).  This rule will be further discussed at the April 16, 2020, Rules Committee meeting, with internet technology experts from OCIO, or other agencies sharing their views.

  1.  Discussion of proposing rule interpreting Iowa Code section 23.7(1) “complainant could have become aware of the violation” language

This will be discussed at a future meeting when we know the outcome of HF2416, which increases IPIB filing deadline from 60 to 90 days

  1.  Discussion of proposing a rule to define “expenses to be incurred” and “reasonable fee” in Iowa Code section 22.3.

This will be discussed at a future meeting.

  1.  Discussion of proposing a rule interpreting release of utility records pursuant to Iowa Code section 388.9A.

This may be beyond the jurisdiction of the IPIB’s rule making authority.

  1.  Review of ARC 4840, proposed rule by the Insurance Division.

No further action will be taken by the IPIB.

The committee adjourned at 12:45 p.m.
