Electronic meeting pursuant to Iowa Code section 21.8 – In circumstances where an in-person meeting is impossible or impractical due to concerns about COVID-19 and social distancing for the safety of board members and the public.

 

I.       Call to Order / Introductions – Meeting called to order at 3:35 p.m. on August 5, 2020, as an electronic meeting pursuant to Iowa Code section 21.8; in person meeting was impractical due to health and safety concerns with the COVID-19 pandemic. Members present: (by telephone) Luchtel and Thompson; (in person) Giovannetti and Morain. Staff (in person): Johnson.  Guests (by telephone): Susan Patterson Plank and Randy Evans.    

II.        Approve Agenda – Luchtel moved to move Item VII forward to follow Public Comment.  Seconded by Morain.  Unanimously approved.

III.       Approve minutes from August 7, 2019, meeting – Motion by Giovannetti, second by Morain.  Unanimously approved.

IV.       Public Comment – None.  

V.      Discussion concerning whether to resubmit all of the 2020 legislation:  HF 2416 (amending Iowa Code section 23.7 to expand filing deadline from 60 to 90 days) and HF 2308 (amending section 21.2 concerning the definition of ‘Meeting” and section 21.4 to exclude weekend days and paid holidays from the 24 hour notice calculation).  

Members discussed whether to include the new subsection inserted by amendment after filing (section 21.4(5) to define ‘good cause’).  Motion by Giovannetti, second by Morain to resubmit HF 2308 without the addition of the section defining ‘good cause’.  Unanimously approved.  

Motion by Morain, second by Giovannetti to refile HSB 505 (expanding notification provisions to all who request such, Iowa Code section 21.4(1)(a)).  Unanimously approved.  

Motion by Luchtel, second by Giovannetti to resubmit all legislation, including HF 2416, HF 2308 (as originally filed), and HSB 505.  Unanimously approved. 

VI.        Modification of Iowa Code section 22.7(5) – Discussion concerned the progress made in the 2020 session for HSB 623 and the amendment proposed by the Attorney General’s Office concerning Iowa Code section 22.7(5).  The consensus was that IPIB staff review the AG proposal, contact other possible co-sponsors or supporters, and bring another version to the next meeting of this committee.     

VII.    Discuss other possible legislative proposals – Susan Patterson Plank asked that the IPIB consider amending Iowa Code section 23.3(1) to clarify that the IPIB board membership must include three media representatives and three members of cities, counties, and other political subdivisions of the state.  IPIB staff was directed to draft legislation for committee review at a future meeting.

VIII.   Adjourn – Motion by Morain, second by Thompson.  Unanimously approved.  Meeting adjourned at 4:40 p.m.
