Unapproved Minutes

The Board met electronically on June 18, 2020 for its monthly meeting at 1:05 p.m. by conference call originating from the 3rd floor IPIB Office Conference Room in the Wallace Building with the following members participating by telephone: Joan Corbin, Pella; E. J. Giovannetti, Urbandale; Keith Luchtel, Clive; Monica McHugh, Zwingle; Rick Morain, Jefferson; Julie Pottorff, Des Moines; Suzan Stewart, Sioux City; Stan Thompson, Clive.  Also present were IPIB Executive Director Margaret Johnson; IPIB Deputy Director Brett Toresdahl; IPIB Legal Counsel Zach Goodrich. A quorum was declared present.

Others identified on the call: John Lande, Eric Henely, Tim Whipple, Randy Evans, and Susan Patterson-Plank.

The IPIB held an electronic meeting pursuant to Iowa Code section 21.8 – In circumstances where an in-person meeting is impossible or impractical due to concerns about COVID-19 and social distancing for the safety of board members and the public.

On a motion by McHugh, second by Giovannetti the agenda was unanimously adopted.

On a motion by Stewart, second by Thompson, to approve the May 21, 2020 minutes as amended. Unanimously adopted.

                  No comments.

  1. Board Chair – Election of officers annually takes place at the July meeting. Chair discussed committees and invited board members to consider one to serve on.

    1. Curran, Christopher (20AO:0002 – Chapter 22 – 5/12/20) A motion by McHugh and second by Corbin to adopt the advisory opinion.  Unanimously approved, roll call 7-0 with Thompson abstaining.

  1. Aultman, Richard (20FC:0055 – Chapter 22 – Fremont County Sheriff’s Office 5/31/20). A motion by Giovannetti and second by Morain to approve the dismissal order.  Unanimously approved, roll call 8-0.

  3. Beymer, Jared (19FC:0132 – Chapter 21 – Crawford Co. Land Mobile Radio Advisory Board 11/10/19).  A motion by Giovannetti and second by Stewart to approve the motion to continue the informal resolution. Approved, roll call 8-0.
  4. Clayworth, Jason (19FC:0138 – Chapter 22 – Des Moines Water Works 11/26/19).   A motion by McHugh and second by Stewart to go into closed session pursuant to Iowa Code §21.5(1)(a): To review or discuss records which are required or authorized by state or federal law to be kept confidential. Clayworth 19FC:0138 continued. John Lande spoke on behalf of the Des Moines Waterworks and Tim Whipple spoke for the Iowa Association of Municipal Utilities.  A motion by Stewart and second by McHugh to table for review of additional documents. Approved, roll call 6-1 with Morain voting nay and Giovannetti abstaining.

  1. Henely, Eric (20FC:0053 – Chapter 21 – Gilbert Community School District 5/26/20).  A motion by McHugh and second by Stewart to approve the dismissal order.  Approved, roll call 7-1 with Giovannetti nay.
  2. Henely, Eric (20FC:0054 – Chapter 21 – Gilbert Community School District 5/28/20). A motion by Thompson and second by McHugh to approve the dismissal order.  Unanimously approved, roll call 8-0.

7)  Updates for the board.

            a. Johnson provided an overview of the May website use and YTD case totals.

            b. Toresdahl shared the FY20 financials. Also shared budget appropriation projections for FY21.

            c. Johnson shared completed presentations/trainings – none currently scheduled.                          

            d. Johnson provided an update on the District Court Cases.

            e. COVID-19 impact on IPIB – Discussed current work environment and future Board meetings.

The next IPIB meeting will be in the Wallace Building, 3rd Floor E/W Conference Room, July 16, 2020, at 1:00 p.m.  

At 3:53 p.m. the meeting adjourned on a motion by McHugh and a second by Luchtel.Unanimously approved.
