                                                            Approved Minutes

 

The Board met on June 17, 2021 for its monthly meeting at 1:00 p.m. in the 3rd floor E/W Conference Room in the Wallace Building with the following members present: E. J. Giovannetti, Urbandale; Barry Lindahl, Dubuque; Keith Luchtel, Clive; Monica McHugh, Zwingle; Rick Morain, Jefferson; Julie Pottorff, Des Moines; Suzan Stewart, Sioux City; and Stan Thompson, Clive.  Absent: Joan Corbin, Pella.  Also present were IPIB Executive Director Margaret Johnson; IPIB Deputy Director Brett Toresdahl; IPIB Legal Counsel Zach Goodrich. A quorum was declared present.

Others identified present or by phone: Laura Belin, Douglas Fulton, Ian Arp, Nicole Cox, Kelly Shaw, and Kay Bergren.                                                                                                                                                                                                         

On a motion by McHugh, second by Lindahl the agenda was unanimously adopted.

On a motion by Morain, second by Giovannetti, to approve the May 20, 2021 minutes. Unanimously adopted.

Public Forum - No comments

  1. Board Chair – Being in-person for the first time in 16 months, she had all introduce themselves.  Reminded Board that in July officers will be elected.
     
  2. Advisory Opinions - None

   3)  The board was briefed on cases and took action as indicated: 

  1. Belin, Laura (20FC:0095 – Chapter 22 – University of Iowa 9/17/20). Laura Belin and Ian Arp spoke on this matter. A motion by Lindahl and second by Giovannetti to dismiss the matter for lack of probable cause to believe a violation has occurred. Roll call vote, approved 6-1, with Giovanneti, Lindahl, Luchtel, McHugh, Pottorff, and Stewart voting yea; Morain voting nay; and Thompson abstaining.
  2. Bergren, Kay (21FC:0003 – Chapter 22 – City of Otho 1/7/21). Kay Bergren spoke on the matter. A motion by Giovannetti and second by Luchtel to approve the informal resolution final report and dismiss the complaint. Unanimously approved, 8-0.
  3. Kuhn, Mark (20FC:0128 – Chapter 21 – Floyd County Board of Supervisors 12/17/20). A motion by Luchtel and second by McHugh to approve the informal resolution final report and dismiss the complaint. Unanimously approved, 8-0.
  4. Stewart, Margie (21FC:0038 – Chapter 22 – City of Cincinnati 5/12/21). A motion by McHugh and second by Thompson to approve the dismissal order.  Unanimously approved, 8-0.
  5. Sullivan, Cristie (21FC:0034 – Chapter 22 – City of Van Meter 4/25/21). A motion by Giovannetti and second by Stewart to approve the dismissal order.  Unanimously approved, 8-0.
  6. Shaw, Kelly (21FC:0040 – Chapter 21 – Indianola City Council 5/18/21); Armstrong, Steve (21FC:0041 – Chapter 21 – Indianola City Council 5/19/21); Erickson, Stephanie (21FC:0042 – Chapter 21 – Indianola City Council 5/19/21). Douglas Fulton spoke on the matter.  A motion by Stewart and second by Luchtel to consolidate and approve the dismissal order.  Unanimously approved, 8-0.
  7. Swearingin, Kim (21FC:0009 – Chapter 21 – Wayne Co. Board of Supervisors 2/14/21). A motion by Thompson and second by Lindahl to approve the informal resolution final report and dismiss the complaint. Unanimously approved, 8-0.
  8. Uker, Ben (21FC:0044 – Chapter 22 – Iowa State Patrol 5/24/21). A motion by McHugh and second by Stewart to continue this complaint until the next meeting at the request of legal counsel for Ben Uker. Unanimously approved, 8-0.
  9. Vaughn, Deb (21FC:0027 – Chapter 21 – Springville City Council 3/29/21). A motion by Giovannetti and second by Morain to approve the dismissal order.  Unanimously approved, 8-0.
  10. Watson, Steven (21FC:0011 – Chapter 21 – Indiana Township Bd. of Trustees 2/22/21).  A motion by McHugh and second by Luchtel to approve the informal resolution final report and dismiss the complaint. Unanimously approved, 8-0.

  3. Rules – The next meeting will be held in July.  A motion by Stewart and a second by McHugh to amend Iowa Administrative Code 497, Chapter 9, “Waivers or Variances from Administrative Rules”.  Unanimously approved, 8-0.

7)  Updates for the board.

            a. Johnson provided an overview of the May website use and YTD case totals.

            b. Toresdahl shared the FY21 financials and budget preparation for FY22.

            c. Johnson provided an update on the District Court Cases.

                        Klein – Supreme Court is retaining.

                        Ripperger – Supreme Court is retaining.

d. Future presentations/trainings - None scheduled at this time.                               

            e. COVID-19 impact on IPIB – Discussed future in-person Board meetings and building status.

            f.  Board Manual – Replacement sections of manuals will be distributed at the July meeting.

The next IPIB meeting will be in the Wallace Building, 3rd floor E/W Conference Room, July 15, 2021, at 1:00 p.m.  

At 3:04 p.m. the meeting adjourned on a motion by Stewart and a second by McHugh.Unanimously approved.
