The Board met on February 20, 2020 for its monthly meeting at 1:00 p.m. in the 3rd floor E/W Conference Room of the Wallace Building with the following members present: E. J. Giovannetti, Urbandale; Keith Luchtel, Clive (telephone); Monica McHugh, Zwingle; Rick Morain, Jefferson; William Peard, Waukee; Julie Pottorff, Des Moines; Suzan Stewart, Sioux City; Renee Twedt, Story City (telephone at 1:07pm/In person at 2:01pm); Mary Ungs-Sogaard, Dyersville (telephone).  Absent: E. J. Giovannetti, Urbandale. Also present were IPIB Executive Director Margaret Johnson; IPIB Deputy Director Brett Toresdahl; and IPIB Legal Counsel Amanda Adams. A quorum was declared present.

On a motion by Ungs-Sogaard, second by McHugh the agenda was unanimously adopted.

On a motion by Stewart, second by Morain, to approve the January 16, 2020 minutes. Unanimously adopted.

Public Forum

                  No comments.

Note: Twedt joined meeting by telephone at 1:07pm

Items Discussed

  1. Board Chair  –  No comments from chair.  Johnson reminded Board members that terms expire in April for four individuals. If Board members want to continue another term, they should contact Johnson and the Governor’s office.

   2)  The board was briefed on cases and took action as indicated: 

  1. Adams, Nicole (19FC:0147 – Chapter 22 –Guthrie County 12/26/19). A motion by McHugh and second by Peard to approve the dismissal order.  Unanimously approved.
  2. Anonymous (20FC:0009 – Chapter 21 – Humboldt Comm. School Board 1/22/20). A motion by Peard and second by Morain to approve the dismissal order.  Unanimously approved.

The Board had a brief discussion about anonymous complaints and how to best handle them. No action taken.

  1. Banks, James (20FC:0003 – Chapter 22 – Polk County Attorney’s Office 1/12/20). A motion by McHugh and second by Stewart to approve the dismissal order.  Unanimously approved.
  2. Banks, James (20FC:0004 – Chapter 22 – Des Moines Police Department 1/12/20). A motion by Morain and second by McHugh to approve the dismissal order.  Unanimously approved.
  3. Christensen, Stephanie (19FC:0052 – Chapter 21 – Bettendorf School District 5/17/19). A motion by Stewart and second by McHugh to approve the report and final order.  Unanimously approved.
  4. Clayworth, Jason (19FC:0138 – Chapter 22 – Des Moines Water Works 11/26/19). A motion by Stewart and second by McHugh to table this complaint until documents can be reviewed at the next meeting. Unanimously approved.
  5. Curry, Nina (19FC:0097 – Chapter 22 – Dept. of Corrections Sixth District 7/28/19). A motion by Morain and second by McHugh to accept the report that no probable cause exists. Unanimously approved.
  6. Kruse, Kurt (19FC:0129 – Chapter 22 – City of Madrid 10/27/19). A motion by McHugh and second by Twedt to approve the dismissal order.  Unanimously approved.

   Note: Twedt arrive at 2:01pm to the meeting in person.

   Note: The Board took a brief recess at 2:03pm.

   Note: The Board resumed the meeting at 2:06pm with Twedt as Chair.

  1. Miller, Joel (19FC:0144 – Chapter 22 – Iowa Secretary of State 12/12/19). A motion by Peard and second by Stewart to approve the dismissal order.  Unanimously approved.
  2. Miller, Joel (20FC:0010 – Chapter 22 – Iowa Secretary of State 1/31/20). A motion by McHugh and second by Pottorff to approve the dismissal order.  Unanimously approved.
  3. Radtke, Mari (20FC:0005 – Chapter 22 – Archer City Council 1/13/20). A motion by Pottorff and second by Morain to approve the acceptance order. Unanimously approved.
  4. Schleicher, Mike (20FC:0006 – Chapter 21 – Jefferson Co. Extension Council 1/14/20). A motion by Stewart and second by McHugh to approve the dismissal order.  Unanimously approved.
  5. Sellers, Darran (19FC:0148 – Chapter 21 – Vinton City Council 12/31/19). A motion by McHugh and second by Pottorff to approve the acceptance order. Unanimously approved.
  6. Vaughn, Deb (20FC:0002 – Chapter 21 – Lisbon School Board 1/10/20). A motion by Stewart and second by McHugh to approve the dismissal order.  Unanimously approved with Ungs-Sogaard recusing herself.

6)  Committee Reports

  1. Communications – Johnson  reported on communication that she sent to OCIO regarding how the open records law is affected by the NextSource portal implementation.
  2. Legislative – Johnson reported on status of IPIB legislation and other matters of interest. There was a discussion that the Executive Director registers on legislation only if the Board has given certain direction. A motion by McHugh and second by Pottorff for the Executive Director to register in favor of HF2236. Unanimously approved.
  3. Rules – Meeting was held prior to the Board meeting. Meta data and electronic records were the topics.  More research will be conducted.

7)  Updates for the board.

            a. Johnson provided an overview of the January website use and YTD case totals.

            b. Toresdahl shared the FY20 financials. Also shared budget appropriation projections for FY21.
